The Role
Our client in the Education space in Melbourne, is seeking a family lawyer. In particular, we are seeking someone who has experience dealing with discrimination in the Schools space.
Key responsibilities will include advising on the below matters -
Child Safety: Duty of care, ministerial orders, and reportable conduct.
Parent/Student Conduct: Application of school policies, trespass notices, and codes of conduct.
Privacy Law: Interpreting the Privacy Act 1988 and managing requests for information.
Equal Opportunity/Discrimination: Addressing disability complaints and representing schools in conciliations with the VEOHRC.
Criminal Law: Assessing potential offences and providing guidance.
Commercial Contracts: Reviewing agreements entered into by schools.
Governance: Advising on ACNC, tax matters, and organisational policies.
Debt Recovery: Handling cases of unpaid school fees.
Copyright: Ensuring compliance with the Copyright Act 1968 in the educational use of art, text, film, and music.
Family Law: Interpreting Family Court custody orders, intervention orders, and parental agreements.
Defamation: Providing advice as needed.
Key Requirements
- A legal adviser with at least 5 years of PQE
- Experience providing legal advice to schools.
- Experience advising religious organisations would be advantageous
- In-House lawyers with generalist skills may also be considered
